What information should be included in my request letter?

Please be as specific as possible when requesting records, so that we may properly identify which records maintained by the Justice Center are responsive to your request. Please also include the return address where you want our response sent.

Records requests must be made in writing and submitted either by mail, fax, e-mail or hand-delivered to our office.

What records are maintained by the Justice Center?

Pursuant to section 87(3)(c) of the Public Officers Law, a Subject Matter List of records in the possession of the Justice Center has been posted to this website. Many of the records on the list can be found on the website under the Resources tab.

When are records available for inspection?

Upon appointment, public records maintained by the Justice Center are available for inspection and copying on weekdays between the hours of 9:00 AM and 5:00 PM at the NYS Justice Center for the Protection of People with Special Needs, 161 Delaware Avenue, Delmar, New York 12054.  Requests for inspection must be in writing and addressed to the Records Access Officer.

What is the procedure for appealing a denied FOIL request?

If your FOIL request is denied, you will be notified in writing and you will have 30 days from the date of such written determination to submit an appeal.  Your appeal must be in writing to:

Where can I obtain more information about FOIL?

The Committee on Open Government, an agency of the NYS Department of State, is responsible for overseeing and advising with regard to FOIL, the Open Meetings Law and the Personal Privacy Protection Law.
